These Terms & Conditions (“Terms”) govern your use of the website rockytopconstruction.ca and your engagement of services provided by RockyTop Construction Ltd. (“RockyTop,” “we,” “us,” or “our”). By browsing our website, requesting a quote, or hiring us for any service, you agree to be bound by these Terms.

1. Scope of Services

RockyTop provides commercial and residential construction, renovations, maintenance, snow & ice management, irrigation, parkade cleaning, and related services across Calgary and surrounding areas. The exact scope, materials, start date, and deliverables for a project will be outlined in your written estimate, proposal, or contract (collectively, “Agreement”).

2. Quotes & Estimates

• All quotes/estimates are based on information available at the time of assessment and are generally valid for 30 days unless otherwise stated.
• Pricing may change due to market fluctuations, material availability, unforeseen site conditions, client-requested changes, or permit/inspection requirements.
• Any adjustments will be communicated in writing before work proceeds.

3. Project Scheduling

Start and completion dates are subject to weather, material availability, and scheduling logistics. RockyTop is committed to completing all work in a timely and professional manner while maintaining high safety and quality standards.

4. Payments & Invoicing

• Payments are due as outlined in your Agreement or invoice.
• Late payments may be subject to interest charges of 2% per month (24% annually).
• Ownership of materials or finished work remains with RockyTop until full payment is received.

5. Client Responsibilities

• Ensure safe and reasonable site access for our crews and equipment.
• Obtain all necessary approvals or permissions not handled by RockyTop.
• Notify us promptly of any site hazards, underground utilities, or restricted access conditions.

6. Warranties & Workmanship

RockyTop warrants its workmanship for a defined period as specified in your Agreement. This warranty covers defects in installation or materials supplied by RockyTop but excludes damage from misuse, neglect, natural disasters, or third-party interference.

7. Liability

To the fullest extent permitted by law, RockyTop Construction Ltd. shall not be liable for indirect, incidental, or consequential damages, including loss of revenue or property, arising out of or related to our services or website.

8. Cancellations & Termination

Either party may terminate an Agreement with reasonable written notice. Deposits may be non-refundable if materials have been purchased or work has begun. Incomplete or cancelled projects will be billed for work and materials completed up to the termination date.

9. Website Use

All content, images, and materials on rockytopconstruction.ca are the property of RockyTop Construction Ltd. and may not be copied, reproduced, or distributed without written consent. Unauthorized use may violate copyright or trademark laws.

10. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the jurisdiction of Alberta courts.
